These terms and conditions are an addendum to Furniture Concepts (Schwalbe Import and Export cc T/A Furniture Concepts) standard terms and conditions and whilst if simplifies and clarifies aspects of the standard terms and conditions it does not replace or supersede them.

Standard Terms and Conditions

Conditions of Sale

  1. Goods to be paid for in full before delivery. Payment will be either cash, credit cards, debit cards or finance approved and offered by Furniture Concepts (Schwalbe Import and Export cc T/A Furniture Concepts) only.
  2. Lay byes will only be facilitated in store and will be kept for a period of 3 months.If not collected within 3 months prices will be subject to alteration or goods will be sold to defray expenses.
  3. Transfer of ownership of delivered goods will only revert to the purchaser after the purchase price (sum) of the goods have been paid in full.
  4. Prices are subject to revision as are any legitimate error on behalf of the salesman or any employee of Furniture Concepts or their associates.
  5. Special orders or goods purchased on Sale may not be returnedor .
  6. All prices quoted are subject to the current VAT stipulated by SARS at any given time.
  7. As per condition 3 above, all goods sold remain the Property of Furniture Concepts who reserves the right, should the full purchase price not be paid after delivery to repossess the goods supplied at any time. The repossession of goods does not relieve the purchaser of his obligation under this agreement.  The seller may at any time after delivery exercise the right explained in this paragraph.  No arrangement which may lead to the extension of payment of the purchase sum shall detract from any right under this agreement.  Should goods in this agreement be delivered at different time, then the purchase price of each article will become payable upon their delivery.
  1. The driver who makes the delivery is instructed not to effect deliver unless payment is made prior to delivery or offloading.
  2. Costs of redelivery due to non-payment of the initial delivery will be borne by the purchaser. .
  3. The seller undertakes to execute all deliveries as soon as possible and according to the expected date of delivery as specified on this agreement, but do not accept any liability for damages which may be suffered as a result of a delay with such delivery.
  4. The purchaser shall not be entitled to cancel the contract simply because the estimated date of delivery had not been met, without a written demand to the seller to affect delivery. The above-mentioned demand must give the seller 14 (fourteen) days from the date of receipt of letter by him to make such delivery.
  5. The purchaser undertakes to accept delivery of goods within five days from date of receipt of ordered goods from the factory by the seller.The seller will be entitled to charge storage at a rate of 4% of the selling price per month if the purchaser does not comply with the delivery period mentioned above.

13. Factory guarantees will be handled as follows

  • The seller undertakes to assist the purchaser in the event of guaranteed claims.
  • The purchaser will, however, be responsible to deliver the damaged articles to the seller’s premises and to collect the articles again after they have been repaired.
  • Should the seller, on request of the purchaser, do the collection and redelivery of repaired articles, the normal delivery fees will apply and will be prepaid by the purchaser.
  1. Only the conditions, as set out in this agreement, form the basis of the contract between Furniture Concepts and the purchaser and no other conditions or guarantees given by the seller or their employees, representatives or their agent are binding unless it has been agreed upon as a written and signed amendment to this contract by the principal.
  2. In the event of a dispute between the seller and the purchaser, both parties to the agreement agree to the jurisdiction of the Magistrate’s Court of Johannesburg to hear such a dispute.
  3. The purchaser will be responsible for all legal costs (including legal costs on attorney-and-client scale and cost of collection) that the seller may have to enter into in order to recover monies owed under this agreement.
  4. 20% handling charges of total purchase price will be charged on all cancelled order.

  • NOTE:Only 3rd party credit options approved and offer by Furniture Concepts are valid and no other credit or accounts will be entertained or valid.

All our Deliveries are Gauteng based only. We cannot specify deliveries times and can only give estimates which cannot be guaranteed (as per Management).

21. Delivery, Delivery Dates and Delays

For all deliveries the purchaser needs to ensure that we can access the place of delivery and that the space for the goods is cleared before we deliver and is ready for the goods in all aspects. Note, we can only deliver the goods if they can fit in lifts, on staircases, through passages and through doors at the delivery address. We do not hoist goods onto balconies. Our delivery crew is not permitted to rearrange your furniture or clear areas in preparation for delivery. We always deliver assembled goods, goods assembled on site only by prior arrangement. If you require that we assemble the goods at a date later than the delivery date, we will charge you a call-out fee, which must be paid in advance. We take no responsibility for any damage to the goods or personal injury to you or to anyone else that may suffer should you choose to assemble the goods yourself. Goods delivered will be unwrapped on site and the packing and wrapping material removed unless requested otherwise. The delivery crew is not permitted to move or take away with them any of your unwanted items. It is your responsibility to remove all items of value from the delivery site and that your pets and small children are secured in a safe location away from the delivery site. We do not take responsibility for any items claimed to be missing or any breakages during or following a delivery or any injury that may be of a result of the delivery.

Once your order is received we will contact you to confirm the order and the delivery address and we will confirm availability and delivery cost. We will endeavor to deliver goods within the advised time periods, but goods are subject to availability and the delivery of goods is frequently in the hands of a third party and sometimes delays are outside of our control. Carriers cannot specify an exact hour of delivery. Any dates we specify for the delivery of goods are approximations only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay in the delivery of the goods. Our failure to meet approximate delivery dates will not be grounds for you to cancel the sale. Some orders may be delivered in more than one drop. We will only deliver goods to the address on the order and goods will not be left without a signature. You are required to make all the necessary arrangements to take delivery of the goods whenever they are tendered for delivery. If you are not at home on the date that has been agreed and the delivery agent cannot contact you, we reserve the right to charge you for the re-delivery.

22. Inspection of goods

It is your responsibility to ensure that there is a responsible person at the delivery address to inspect and to sign for the goods. We cannot accept liability for damages or errors if goods have been fitted or altered or if you have had the goods in your possession for more than 48 hours.

PLEASE ENSURE THAT YOU KEEP THE ORIGINAL PACKAGING IN CASE YOU HAVE ANY REASON TO RETURN YOUR PURCHASE (subject to our returns policy set out below).

You must notify us in writing if a product has been delivered incomplete or damaged within 48 hours of your receipt thereof. Please include pictures

23. Risk

The risk in the goods shall pass to you, the customer, on arrival at the delivery address as specified by you.

24. Installation

We do not effect installation and none of our prices include installation.

25. Faulty Goods

Faulty goods must be returned to us at the clients own cost for inspection and testing. Faulty goods will be swopped out if returned within 7 days from purchase, if the purchase exceeds 7 days the item will be send to the manufacturer or factory for repairs or replacement.

PLEASE NOTE THAT NOTWITHSTANDING ANYTHING WHICH IS SET OUT ABOVE, IN ORDER TO SUCCESSFULLY OBTAIN AN EXCHANGE OR REFUND FOR FAULTY GOODS THE GOODS MUST BE RETURNED COMPLETE WITH ALL ACCESSORIES IN THEIR ORIGINAL BOX AND PACKAGING.

26. Guarantees

All products supplied are covered by the terms and conditions of the manufacturer’s guarantee. No further or additional warranties or undertakings will be given by us in regard to the goods.

27. Non-Deliveries

We will not accept liability for goods lost in transit unless we are notified within 7(seven) days from the expected delivery date.

28. Cancellations

You may in certain instances cancel your order. You can cancel your order before it is dispatched for delivery by calling us or emailing Furniture Concepts to do so. If you cancel an order and the goods have already left Furniture Concepts’ warehouse, you will be liable for the delivery fee and a cancellation fee of 20% of the price of the goods. We can only process refunds once we have confirmed that the goods have been returned to our warehouse. If cancellation of an order is initiated by us, no cancellation fees will be payable. 29. Refunds

Refunds will be at our discretion and no refunds will be considered after 7 days from purchase.

30. Returns Policy

Returns to us will be at the purchaser’s expense. If we, for some reason pay the costs relating to any return by you, we shall be entitled to claim a refund of any such payment form you and you shall refund any and all amounts to us on demand. We do not accept returns unless the goods supplied by us are in their original packaging and have not been opened by you.

Notwithstanding what is set out above, we advise that all returns will be at our discretion and you will not be entitled in any way to dispute or query our discretion, once exercised by us.

Subject to what is recorded under this returns policy clause, if returns are received by us after 7 (seven) days from the date of delivery, we will not be obliged to accept the returned goods for the purpose at all.

Privacy Statement

We are committed to protecting your privacy. We will only use the information that you provide, for lawful purposes. We obtain information about you only to process your order and provide you with the best possible service. We will endeavor to ensure that the information we hold will be accurate and up to date and we agree keep such information secure.

Restrictions on use of material

Material on the Furniture Concepts website may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, without the prior written consent from Furniture Concepts.

Trademarks

All company names, logos, trademarks, product names, images or photographs displayed in this website are the property of Furniture Concepts or their respective owners.

Amendment to Terms

Furniture Concepts reserves the right to amend these terms and conditions without notice.

Disclaimer

Although it cannot be guaranteed, it is Furniture Concepts intention keep all information on this website as accurate and up to date as possible. Furniture Concepts shall have the right to refuse or cancel any orders in order to take account of any increase in our prices, or the imposition of any taxes or duties, or if due to an error or omission the price published or quoted for the goods is wrong whether or not the order has been confirmed. Errors on our website are rare, but mistakes can happen and in the unlikely event of an error in price being made on our website, we will contact you and give you the opportunity to amend or cancel your order. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges). We will not be liable for any injuries or financial loss from accidents related to the order or loss of time and monies resulting from delays, non-deliveries and wrong delivery. Price and availability information are subject to change without notice.

Furniture Concepts and its employees and agents accept no responsibility whatsoever for any damages caused by any means howsoever to any person or property upon the delivery, removal, return, installation of goods or for any other reason whatsoever. We do not accept responsibility for time or earnings lost or for any other consequential damages.
